NCAA President Mark Emmert has sent out a memo to member schools urging the importance of the passing of name, image and likeness rules college athletics. Part of the letter can be read below, discussing the rule changes that the NCAA has made recently that will come into effect on July 1, 2021.

“These updated rules are needed to minimize conflicts among athletes’ NIL opportunities across all the states and to reinforce our commitment to the principles of college athletics,” part of the letter read. “Similarly, we have collectively made a promise to Congress, to our campuses, and most importantly, to our student-athletes that we would do so. Certainly, we will continue to work with Congress to encourage them to create a single, national law around NIL, but this will not happen by July. Nor does it relieve us of the need for NCAA rule changes. By July, all our athletes should be provided NIL opportunities regardless of the state they happen to live in.

“Our current rules, as you know, completely prohibit NIL activities and therefore are in conflict with state NIL laws. Schools and athletes following the NIL provisions of their state laws should not be concerned about eligibility issues. Nor should student-athletes in states without NIL laws be deprived of the opportunity to engage in appropriate NIL activities. We must now allow such obvious inequity to occur. We need to pass new rules.

“If, however, NCAA rule changes are not in place by July, please know that I will work with our governance bodies to develop temporary policies that assure student-athletes that they will not become trapped in such circumstances and that all will have NIL opportunities. I have directed my staff to creat proposals to this end. We will provide more details next week as this approach is reviewed by the NCAA Board of Governors and the divisional governance bodies.”

According to ESPN, the NCAA Division I Council meets on Tuesday and Wednesday of this week and could act on a name, image and likeness proposal that has not progressed since January. ESPN says that the NCAA has asked Congress for held in the form of a federal NIL law that would set the same standards for all 50 states.

College athletes have previously not been allowed to make money off of things like jersey sales with their numbers on them, or being paid to sign autographs at an event because of NCAA rules. Instead, the only “payment” that student-athletes have received is via their scholarship, which helps them pay for things like room and board, meals, their tuition and more, or gives it to them entirely for free.
